A group representing Apple Inc. (AAPL), Google Inc. (GOOG) and Nokia Oyj (NOK1V) asked a federal judge to block enforcement of a San Francisco law requiring wireless phone retailers to post what it called “alarmist” warnings about radiation from mobile devices.
The first-of-their-kind warnings, which say radio emissions are a possible carcinogen, may discourage consumers from buying and using mobile phones, CTIA-The Wireless Association, a Washington-based organization representing wireless carriers and device makers, said at a hearing today. City officials say the rule helps keep residents informed about possible health effects from mobile phone radiation.

“How many mothers are going to walk into a retail store and say, I’m not going buy a phone for my 13-year-old because the city has given me this warning,” Andrew McBride, a CTIA attorney, said at a hearing in federal court in San Francisco. “We feel these materials are alarmist, they contain false statements and will harm our business.”

The group is seeking a court order halting enforcement of the rule pending the outcome of its lawsuit challenging the ordinance. The city agreed at the hearing to delay enforcement until U.S. District Judge William Alsup rules on the group’s request, which Alsup said could happen within two weeks. The law was scheduled to take effect Oct. 25.
Today’s hearing revives debate among lawmakers, researchers and wireless companies about whether frequent mobile phone use can lead to cancer or other illnesses. Lawmakers in Washington said more research was needed after some studies suggested a link between wireless phone radiation and cancer, while the industry’s trade association said scientific evidence has overwhelmingly indicated that mobile phones don’t pose a health risk.

‘Right to Know’
The nation’s first mobile phone “Right to Know Ordinance,” approved by San Francisco city supervisors last year, requires retailers to use posters, factsheets and display stickers saying emission of radio frequency energy by mobile phones is absorbed by the head and body, such energy has been classified by the World Health Organization as a possible carcinogen and consumers should reduce their exposure, according to court filings.

The ordinance violates the U.S. Constitution’s First Amendment right to free speech because it forces retailers to disseminate the city’s opinion, CTIA said. It’s also outweighed by federal radio-wave exposure standards that ensure all mobile phones sold in the U.S. are safe for consumer use, the group said in court documents.

Biological Damage
Radio waves from wireless phones don’t have enough energy to cause the kind of biological damage that radiation from X- rays can cause, the group said. The Federal Communications Commission said there is currently no scientific evidence establishing a link between wireless device use and cancer or other illnesses.“What do you say about” that? Alsup asked lawyers for the city. “The best thing the World Health Organization can say is that it’s a possible. Anything is possible. Let’s put out a brochure about UFOs.”

The comparison “belittles” the work of researchers that have studied the possible health effects of mobile phone emissions for decades, said Vince Chhabria, deputy city attorney.
The information that retailers are required to disseminate is accurate and doesn’t violate free speech rights, Chhabria said.
‘Editorial Content’
“This is not a situation where the city is requiring somebody to alter their editorial content,” he told Alsup. “It’s requiring a company to provide information about a product in connection with the sale of the product.”

CTIA takes issue with 11-inch by 17-inch posters created by the city’s Department of Environment that show mobile phones emitting bright red, orange and yellow rings that penetrate the head and midsection the body and suggesting consumers keep phones away from the body. Retailers that don’t display the posters can be fined as much as $100 for the first violation.

Alsup questioned the suggestion on the factsheet that mobile phone users wear the devices on belt clips to reduce exposure.
“You are saying an eighth of an inch makes a difference?” Alsup said. “I don’t understand the science behind that suggestion.”

User Manuals
Chhabria said manufacturers’ own user manuals make clear that small distances make a difference with long-term health effects.
“The statement about keeping phones away from your body is not inaccurate, it’s not misleading,” said Chhabria.

Words used on the posters, such as “precautions” and “away from the body,” are the same terms used by manufacturers in their user manuals, he said in court filings. CTIA wants that information to remain in the fine print, and not be called out in posters buyers might see when perusing the displays at the local Verizon Wireless store, according to the filings.

“In this age of cell phone ubiquity, it strains credulity to speculate (as CTIA does) that the materials would cause consumers to forego cell phones altogether,” Chhabria said in the filing. “After all, the materials inform people how to mitigate possible risks, so why, armed with these tips, would people want to forgo the phones?”

For the first time the Court of Appeal of Brescia in Italy has recognised that excessive use of mobile phone can cause cancer.
In a revolutionary judgement, the Court of Appeal of Brescia has recognised that physical harm is cause by the electromagnetic waves and the mobile phone.

The cases concerned Innocente Marcolini, who was head finance of a very important company in Brescia and who in 2002 started getting excruciating pains in the part of his face where he uses the mobile phone. In effect Marcolini used the mobile phone for five hours a day negotiating and concluding contracts with the company’s clients. After being operated for the tumor, his face is now semi-paralysed, he has lost his sense of touch and half his tongue and has great problems with his left eye, as well as difficulties in chewing and in speaking. He now suffers from 80% disability, and has to undergo extensive therapy and physiotherapy.

In his case, the Court of Appeal recognised that the cause of his condition was s the excessive use of mobile phones, and concluded that his use for business purposes constitutes injury on duty.

Of course it was not easy for Marcolini to convince the industrial tribunal that the cause of his disability was the use of the mobile phone and he was lucky to find the support of a neurosurgeon from Brescia, Dr Giuseppe Grasso, and two neurologists, Angelo Gino Levis and Paolo Liberini. In effect, Marcolini lost his case before the industrial tribunal, but then won it on appeal. In this landmark judgement – not only for Italy but also for us and for many EU member states – the Court has for the first time recognised that there are electromagnetic waves caused by the use of mobile phones do cause harm.

Although many countries like Malta are awaiting instructions from the World Health Organisation, there are other countries which argue that it is better safe than sorry, and which have legislated a lower rate of emission from these electromagnetic waves than that of 45 established by the WHO.

The final results of an international study by WHO, intended to produce definitive evidence on whether cell phones cause cancer, could be released any day now. Nine years ago the World Health Organisation launched ‘interphone’ to determine whether brain tumors can be linked to electromagnetic radiation from cell phone. The researchers analysed cell phone use by 14,000 people in 13 countries. Half of the participants had brain tumors; half did not. Fieldwork for the study ended in 2006 but a final paper has yet to be published.

It is true that there is conflicting evidence on the subject, but prevention is better than cure, and it is wrong for Malta to continue to lay back awaiting the concluding evidence from the WHO. There are non-governmental organisations and associations who teach us how to use the mobile phone correctly. They give the following clear instructions:
> Mobile phones must not be used with the blue-tooth on, and with speaker on, because the intensity of the electromagnetic waves diminishes rapidly with the distance;
> Avoid long telephone conversations; use your mobile phone when there is a good reception because a low reception means more emissions;
> Do not leave the mobile phone on your bedside table at night (or worse, under the pillow) and do not charge the mobile phone near the bed;
> Dring the day, do not leave it on in your pocket or in contact with your body but always leave it on the table or in your handbag;
> Do not leave it on in hospitals or in the presence of medical equipment;
> The use of mobile phones by children must be very limited, and in England the Ministry of Health discourages the use of mobile phone by children under 14 years of age;
> When buying a mobile phone ask about its level of emissions;
> In closed areas the level of emissions increases and avoid the use of mobile phones and use the fixed line (and not cordless).

Other NGO’s such as the Environmental Working Group (EWG), lists on its website the list of the best phones (low emissions) and worst phones (high emissions) so that the consumer is informed before making his choice. In Malta we calculated the best and the worst by the shape and the functions and we ignore completely the level of emissions.
EWG published a 2009 ranking of all digital cell phones by their SAR levels and for a complete list go to 32g.org but it is interesting to note that Samsung Impression SGH-a877 is the first for low-radiation model and Motorola Moto vu 204 is the first for high radiation model.

It also gives the following tips for a safer phone:
1. BUY A LOW-RADIATION PHONE
Look up your phone on EWG’s buyer’s guide: www.ewg.org/cellphoneradiation/Get-a-Safer-Phone. (Your phone’s model number may be printed under your battery.) Consider replacing your phone with one that emits the lowest radiation possible and still meets your needs.
2. USE A HEADSET OR SPEAKER
Headsets emit much less radiation than phones. Choose either wired or wireless (experts are split on which version is safer): www.ewg.org/cellphoneradiation/Get-a-Headset. Some wireless headsets emit continuous, low-level radiation, so take yours off your ear when you’re not on a call. Using your phone in speaker mode also reduces radiation to the head.
3. LISTEN MORE, TALK LESS
Your phone emits radiation when you talk or text, but not when you’re receiving messages. Listening more and talking less reduces your exposures.
4. HOLD PHONE AWAY FROM YOUR BODY
Hold the phone away from your torso when you’re talking (with headset or speaker), not against your ear, in a pocket, or on your belt where soft body tissues absorb radiation.
5. CHOOSE TEXTING OVER TALKING
Phones use less power (less radiation) to send text than voice. And unlike when you speak with the phone at your ear, texting keeps radiation away from your head.
6. POOR SIGNAL? STAY OFF THE PHONE
Fewer signal bars on your phone means that it emits more radiation to get the signal to the tower. Make and take calls when your phone has a strong signal.
7. LIMIT CHILDREN’S PHONE USE
Young children’s brains absorb twice the cell phone radiation as an adult’s. EWG joins health agencies in at least 6 countries in recommending limits for children’s phone use, such as for emergency situations only.
8. SKIP THE ‘RADIATION SHIELD’
Radiation shields such as antenna caps or keypad covers reduce the connection quality and force the phone to transmit at a higher power with higher radiation.

In a report published on the last Sunday’s San Diego Union Tribune, Scott Lafee argues that much of the current research is funded by the wireless communications industry, and quotes a paper published in the March 2009 issue of the journal Environmental Health Perspectives, by Michael Kundi, director of the Institute of environmental Health at the Medical University of Vienna in which Kundi concluded that while the studies generally indicate an increased cancer risk, the research was flawed by various biases and lack of long-term data.
In other words, he said nobody knows anything for sure.
But in the case of Innocente Marcolini, the Court of Appeal of Brescia is sure that his semi-paralyzed face was caused by the use of his mobile phone.

SEAL BEACH, Calif. (KABC) — A new cellphone study is stirring up controversy over radiation levels. The report examines the cellphone controversy from an engineering point of view.

Government experts have always contended that cellphones in the United States must comply with the Federal Communication Commission (FCC) standard. Now those measurements are coming into question.
Most people aren’t 6 feet 2 inches tall or weigh 220 pounds. Yet a new report says that’s the model the government uses to test cellphone radiation.

“The standard for cellphones have been developed based on old science and old models and old assumptions about how we use cellphones,” said Dr. Devra Lee Davis, Environmental Health Trust.

A new report from the Environmental Health Trust, a group of researchers promoting awareness of environmental health risks, says this can be concerning news for the rest of us, especially women and children.

“In children and young adults, especially women of shorter stature and petite, the skull thickness is less, considerably less,” said St. Vincent Medical Center neurologist Dr. Fardad Mobin.

Dr. Mobin says the thinner the skull, the more radiation penetrates. And he says the brains of children absorb more radiation.
“Children are in the phase of development. Their brain is more susceptible because of the higher water content to microwave-type energy,” said Mobin.

The government had no specific comment on this report, but the FCC website says: “no scientific evidence currently establishes a definite link between cellphones and cancer or any other illnesses.”
Yet many doctors say all the latest evidence suggests the non-ionizing radiation from these devices may not be inert.

Even when you’re not making a phone call, experts say your cellphone is still emitting some radiation. So what about the woman who keep it on her belt hook or the man who keeps it in his pocket all day long?
Mobin says try to keep the phone 10 inches away from your body. Don’t let it sit on your lap in the car.

Bluetooth devices also emit radiation so you’re better off with wired headphones.
The Environmental Health Trust is calling for the government to do more comprehensive testing on models representing both genders and different ages.

SAN FRANCISCO (KGO) — There is new concern about the danger of radiation from cellphones, but the science behind that new warning is being questioned.

The government agency which regulates cell phones says there’s no basis for establishing a different safety threshold, but researchers from a group called the Environmental Health Trust believe the federal testing methods are flawed.

LLoyd Morgan is one of the researchers behind the study that looks at how the Federal Communications Commission sets radiation safety standards for cellphones. They found the FCC’s tests are done on plastic heads the size of a 6 foot 2 inch, 220 pound man, which they say corresponds to just 3 percent of the population. http://abclocal.go.com/kgo/story?section=news/health&id=8394807

Because of that, the researchers believe the government’s test underestimates the amount of radiation 97 percent of cellphone users are exposed to. Morgan says children are the most vulnerable.
“Children’s tissues are more absorbent of the radiation, their skulls are thinner, their heads are smaller so they receive dramatically more radiation than adults,” Morgan said.
But many scientists say there are no conclusive studies linking cancer and radiation.

“There are different types; the radiation from x-rays is ionizing radiation, the kind from cellphones is the same from microwave ovens, there is no good proof that that caused cancer,” ABC News Health and Medical Editor Dr. Richard Besser said.

The cellphone industry organization agrees, saying, “The weight of scientific research has not linked the use of cellphones with any health concerns.”
But Monday’s report is unsettling for some cellphone users ABC7 talked with.
“It’s not going to make me put down my cellphone, it’s just one of those other carcinogens we’ll have to deal with,” Karen Tannenbaum said.
Both the federal government and the authors of Monday’s study agree that those who want to reduce radiation exposure can hold their cellphones away from the head and body, or use a speaker or hands-free device.

Syracuse (WSYR-TV) – A new study by the Environmental Health Trust indicates that children are more susceptible to cellphone radiation than their parents.

Testing found children absorbed twice as much radiation in their heads – up to three times as much in parts of the brain – and as much as 10 times more in their bone marrow when compared with adults.

Doctors say there’s no reason to become alarmed about the new findings. Dr. Michael Lax, who is also the medical director at Upstate CNY Occupational Health Clinical Centers, says the information is an important piece of a puzzle that’s still being put together.

“There’s that much that we know and (a lot) that we don’t know about it,” said Dr. Lax. “I think we’re still learning about the affects of this kind of radiation.”

There are two types of radiation. Doctors say ionizing radiation, which is used in X-rays, does increase the risk of cancer. But the verdict is still out on non-ionizing radiation, which is what’s used in cellphones.

“The main concern is that cellphones cause cancer, brain cancer specifically,” Lax said. “There are some studies that signal that that is in fact the case and some studies that say no, it’s not.”

Some studies claim the radiation has a more significant impact on kids and that they should be looked at more closely since they will be the first generation to experience a lifetime with cellphones.

“I think we have to assume it can be an issue and not just say we don’t know yet and don’t worry about it,” Lax said.

ABC Medical Director Dr. Timothy Besser also weighed in Monday. He says there is no link between cellphones and cancer, but if one has concerns there are easy steps to minimize exposure.

For example, you can hold the phone at a distance or use the speaker phone. Doctors say a Bluetooth device is also an option since it emits a much smaller dosage of radiation than a cellphone.

Doctors also say cell users are better off texting than talking because it keeps the radiation at a greater distance from the head.

Opponents of the Environmental Health Trust study say the testing was not extensive enough. They would like to see more research done. This study tested cellphones on mannequins, the size of which only represented a small portion of the population.

SALT LAKE CITY — A new report raises concerns about cell phone radiation exposure. It says federal tests to determine exposure to cell phone radiation use models with heads larger than the average person’s or child’s.

The report from Environmental Health Trust says the mannequin skull used to test for cell phone radiation is the size of a 6-foot-2, 220-pound man. Researchers say only 3 percent of people have that size of a skull or larger.

Dr. Devra Davis, one of the report’s authors, said, “Ninety-seven percent of Americans have heads smaller than the one that is used to set standards for cell phone safety.”

Researchers say the Federal Communications Commission determines “maximum allowed exposures” and the agency uses the size of a large man to determine that. As a result, there are special concerns about children.

Scientists say children’s heads are exposed to double the cell phone radiation than adults and 10 times the radiation to their bone marrow.
“We believe that there’s enough evidence we ought to move ahead to take precautionary actions,” Davis said. “That belief is what has guided France and Israel and Finland and a number of other nations today to issue precautionary advice.”

The group is calling for new federal standards for testing. It wants a testing model that’s more in line with several of those European countries — something that takes into account the average size of most people’s heads.

The FCC website explains that testing uses “standardized models of the human head and body that are filled with liquids. They simulate the RF absorption characteristics of different human tissues.” Read more about that here.
According to ABC News, the U.S. government has had no specific comment on the report. The FCC and independent scientists have said in the past there’s no conclusive evidence that cell phone radiation is tied to cancer.

Good Morning America Chief Health and Medical Editor, Dr. Richard Besser, says the measurements for government testing are a separate issue from whether the radiation involved is dangerous.
“When you hear the word ‘radiation’ it’s scary,” he said. “But one thing to realize is there are different kinds of radiation.”
“The radiation from X-rays is something called ionizing radiation. That’s clearly shown to increase your risk of cancer,” he continued. “What you get from cell phones is the same radiation you get from microwave ovens. That’s called non-ionizing radiation and it produces heat. There’s no good evidence that that radiation causes cancer.”

He says although there is no proven link between cell phone radiation and cancer, if people don’t want to take any chances they can do the following:
• Limit the number of minutes you or your children are talking on a cell phone
• Use a hands-free device or speaker phone
• Text instead of talk

A new study from the Environmental Health Trust has found that children absorb twice as much microwave radiation from phones as do adults.

Children are currently absorbing twice the cellphone radiation to their heads as adults, says the team, and up to triple in their brain’s hippocampus and hypothalamus.

They also show greater absorption in their eyes, and as much as 10 times more in their bone marrow than adults.

Even for adults, it says, cell phones carried in the shirt or pants pocket exceed FCC exposure guidelines. The reason, says the team, is that the industry-designed process for evaluating microwave radiation is flawed.

The tests are based on the example of a single type of individual, a large man. Far better, says the team, would be to use anatomically based models of people of various ages, including pregnant women.
The amount of radiation absorbed should be determined in all tissue types, they say. Then, cellphones could be certified with children in mind, using the ‘As Low As Reasonably Achievable’ (ALARA) approach used to set standards for radiological devices.

The potential dangers of cellphones – in particular, cancer – are increasingly causing concern, especially when it comes to children.
One big problem in establishing the danger is that cellphones simply haven’t been around that long, or not in the hands of children, at any rate. It could be years yet before the long-term effects of early cellphone use – if any – become clear.

PORTLAND — Cellphone users may be in more danger from low-level radiation than they’re being told, researchers and public health advocates said Monday during a presentation at the University of Southern Maine.
“Our greatest concern is that we’re setting ourselves up … to have an epidemic of cancer in the future that should be prevented right now,” said Dr. David Carpenter, director of the Institute for Health and the Environment at the University of Albany. “In my judgment, the weight of evidence is so strong now” that there should be stronger warnings about the risks.

Carpenter, who spoke through a teleconference connection, was one of several advocates for more aggressive precautions who spoke to a group of nursing students as part of a public health seminar. USM’s School of Nursing and the Environmental Health Trust arranged the seminar and invited the public.

There is no proof that cellphones cause cancer, according to government scientists and agencies.
“The weight of scientific evidence has not linked cellphones with any health problems,” according to a Maine Center for Disease Control statement provided by a spokesman Monday.

The National Cancer Institute has posted a similar statement on its website: “Although there have been some concerns that radiofrequency energy from cell phones held closely to the head may affect the brain and other tissues, to date there is no evidence from studies of cells, animals, or humans that radiofrequency energy can cause cancer.”
Scientists around the world continue to study the possibility of a link. The World Health Organization, meanwhile, recently classified cellphones as “possibly carcinogenic to humans.”

Maine was one of the first states to consider requiring warning labels on cellphones, although the bill was voted down.
Speakers at Monday’s forum urged cellphone users to take simple precautions, such as keeping phones and other wireless devices away from their heads, out of their pockets and off their laps. Headsets that attach to cellphones don’t emit the same levels of radiation, they said.
“Distance is your friend,” said Lloyd Morgan, senior research fellow for the Environmental Health Trust.
Researchers for the trust, a nonprofit that investigates and warns about health risks, published an article Monday in the journal Electromagnetic Biology and Medicine that says the federal government is underestimating the danger of cellphone radiation, especially to children. The authors argue that the government uses the model of a man’s head to test radiation levels, even though children’s smaller heads and thinner skulls make them more vulnerable to the radiation.
Another speaker at the forum, Stuart Cobb of Portland, said he is convinced it was his cellphone use that caused him to have a brain tumor, which was removed two years ago.
Cobb and his wife, Kristen, might never have made the connection, they said. But when he was diagnosed, his doctor asked if he used a cellphone, which led the couple do some research.
Now, Cobb said, he also is convinced that doctors and government agencies should be warning phone users of the health risk before there are a lot more cancer patients to prove it.
“I think this is the tobacco of the 21st century,” he said.

It seems like everywhere a person goes there is at least one person in view with a cell phone to their ear whether it is on the road, in a store, in a parking lot, walking down the street, etc. Even in places where cell phone usage is banned such as concert halls or movie theaters there is the occasional offender, or morelikely, at least a few people using the text messaging feature on their phone. cell phone usage has exploded over the past decade and continues to rise.

Nearly two hundred million people in the United States have cell phone and there are well over one billion users worldwide. That means there are a lot of phonessending their frequencies over the airwaves at any given time. Concern has arisen over whether or not cell phone usage can harm a person’s health. Brain cancer rates in the United States have risen since cell phone were introduced, leading some people to wonder if cell phone usage is the reason for the increase. There have been reports of people developing brain tumors in the exact same spot where they held their cell phone . Some studies have expressed concern over long-term cell phone use, believing it can lead to a person to develop cancer. That is not to say a person who uses a cell phone is going to get cancer, but some studies suggest long-term use increases a person’s risk. Things may not be all gloom and doom however.

A large study done in Denmark with almost a half million cell phone users showed no increase in cancer for cell phone users. Yet, other studies have concluded there is a greater risk of cancer but only with analog phone users. Some other studies conclude that any type of cell phone usage can raise a person’s risk for developing cancer. There are a lot of varying opinions on the subject.

According to the FDA, available data does not show there are definitely health problems associated with using wirelessphones, but the information goes on to say that there is also no proof that wireless phones are completely safe either.
